Digital Web Agency provides digital development and technology services, including:
By using our website or purchasing any service from Digital Web Agency, you confirm that:
These Terms may apply together with a project quotation, invoice, agreement, NDA, or other written document provided for a specific project.
Before development begins, the client is expected to provide complete and accurate requirements. This may include:
Any major requirement provided after development has started may be treated as an additional feature or change request.
The project scope will be based on the features and requirements agreed upon between Digital Web Agency and the client.
Features not included in the agreed scope may require:
Digital Web Agency will communicate significant scope changes before proceeding wherever reasonably possible.
Project pricing is based on the requirements, features, technology, design complexity, integrations, development time, and other agreed factors.
A quotation provided by Digital Web Agency may include development charges, UI/UX charges, backend charges, admin panel charges, deployment charges, support or maintenance charges.
Third-party expenses may be charged separately unless specifically included in the quotation. Such expenses may include:
For projects requiring an advance payment, development may begin after the agreed advance has been received. The advance payment confirms the client's intention to proceed with the project and allows Digital Web Agency to allocate development resources.
The exact advance percentage or amount will be mentioned in the project quotation or agreement.
Unless otherwise agreed in writing:
If a client cancels a project after development has started, the advance payment may not be fully refundable because resources, development time, planning, design, and technical work may already have been allocated.
Where applicable, a cancellation amount may be deducted from the project value based on the work already completed, resources used, and agreed project terms. If the completed work and associated costs exceed the amount already paid, the client may be required to pay the applicable outstanding amount.
Refund decisions will be considered according to the specific project agreement, work completed, third-party expenses, and applicable law.
After approval of the project scope, requests for additional features may be treated as change requests. Additional features may include:
Additional development charges and timelines may apply.
Digital Web Agency may provide UI/UX designs, layouts, prototypes, screenshots, or design previews for client review. The client is responsible for reviewing and approving the design before development proceeds.
Once a design has been approved, major design changes may be treated as additional work.
The client is responsible for providing accurate information and necessary materials within a reasonable timeframe. The client must ensure that they have the legal rights and permissions to use any images, logos, videos, text, brand assets, product information, documents, data, or third-party content.
Digital Web Agency is not responsible for copyright or ownership disputes involving materials supplied by the client.
Projects may depend on third-party services, APIs, platforms, hosting providers, payment gateways, app stores, maps, SMS providers, cloud services, or other external systems. Digital Web Agency does not control third-party services.
Changes, outages, pricing changes, API restrictions, account suspension, policy changes, or technical failures of third-party services may affect project functionality. Additional third-party charges are generally the responsibility of the client unless specifically included in the project quotation.
Unless explicitly included in the project quotation, domain registration, hosting, VPS, cloud infrastructure, SSL, storage, bandwidth, and other hosting-related expenses are the responsibility of the client.
If Digital Web Agency provides hosting as part of a package, the exact duration and limitations will be specified in the relevant quotation or agreement.
Digital Web Agency may provide application publishing and deployment assistance where included in the project. However, approval by Google Play, Apple App Store, or any other platform is controlled by the respective platform.
Digital Web Agency cannot guarantee approval if an application violates the policies, requirements, intellectual property rules, technical requirements, or other standards of a third-party platform. Any platform fees are generally the responsibility of the client unless otherwise agreed.
Digital Web Agency may test the developed application or website before delivery. After delivery, genuine bugs related to the agreed project scope may be reviewed and fixed according to the applicable support terms.
A bug does not include: a newly requested feature, a change in business requirements, a third-party service failure, client-side configuration issues, changes made by unauthorized persons, or problems caused by external services.
Estimated delivery dates depend on project complexity, feature requirements, client feedback, availability of required content, API credentials, third-party services, payment schedule, design approvals, and testing requirements.
Delays caused by missing information, delayed feedback, unpaid invoices, third-party services, or circumstances outside our reasonable control may affect the delivery timeline.
Ownership and delivery of source code, designs, databases, documentation, and other project assets will depend on the agreed project terms.
Unless otherwise agreed in writing, Digital Web Agency may retain rights to its pre-existing frameworks, reusable components, libraries, tools, development processes, and proprietary technology. Third-party libraries and components remain subject to their respective licenses.
Unless a separate confidentiality agreement or written restriction applies, Digital Web Agency may showcase completed projects in its portfolio, website, presentations, or marketing materials.
If a client requires a project to remain confidential or requests that it not be displayed publicly, the client should communicate this requirement in writing.
Both Digital Web Agency and the client should take reasonable steps to protect confidential project information. Confidential information may include business plans, private credentials, source code, technical architecture, private documents, customer information, business strategies, and unreleased product information.
Where an NDA is signed, confidentiality will also be governed by the terms of that agreement.
Technical support and maintenance may be included or offered separately depending on the project. Support may include bug fixing, minor updates, technical guidance, performance improvements, API troubleshooting, and compatibility updates.
Major new features, redesigns, new modules, or significant changes may require additional charges.
